The Attorney General has disputed the claim brought by Idah Lungu, a Lusaka resident, who has filed a lawsuit against Levy Mwanawasa University Teaching Hospital.
Ms. Lungu alleges that a surgical bandage was left embedded in her abdomen following a Caesarean section.
Attorney General Mulilo Kabesha contends that the hospital is not liable for the K1.4 million in special damages sought by Ms. Lungu, asserting that there was no breach of professional duty by the medical staff.
Mr. Kabesha states that the surgeon adhered to established protocols, performing a swab count on two separate occasions to ensure that all surgical instruments were properly accounted for.
Ms. Lungu was discharged from the hospital on January 7, 2023, and subsequently reviewed as an outpatient on January 12, 2023, without any complaints related to the surgery.
The Attorney General has submitted to the Lusaka High Court that the hospital is equipped with modern facilities and staffed by qualified medical professionals, and that appropriate skill and care were exercised during the surgery. He further argues that Ms. Lungu is not entitled to compensation for loss of earnings, medical expenses, or damages attributed to alleged professional negligence.
